Terms and Conditions for the Gbps Customer Experience Trial (“1Gbps Trial”)

By confirming your participating in the 1Gbps Trial, you (“the Participant”) agree to these terms and conditions, which are subject to change at our discretion for the duration of this trial commencing from 15th December 2022 to 31st May 2022.

1. Fibre Broadband Plan

a. The Participant is not permitted to terminate or downgrade their 100Mbps fibre plan to a lower plan for the duration of this trial.

b. The Participant is not permitted to port to other service providers and/or temporarily suspend their existing fibre broadband subscription throughout this trial.

c. Progresif shall be entitled to disqualify and remove any participant from the trial where such participant terminates their subscription, downgrades to less than 100Mbps, porting to other service providers or temporarily suspends their subscription.

2. Provisioning of 1GBPS plan

a. When the Participant is successfully enrolled in the trial, they will be provisioned with a 1Gbps plan. The 1Gbps plan will be accessible via a separate port on the Participant’s modem.

b. The Participant will also be provisioned a total quota of 10TB per month on the 1Gbps plan for the duration of the trial. There will be no option to purchase add-ons for the 1Gbps plan and any add-ons purchased by the Participant will not fall into the 1Gbps plan.

c. During the trial period, the WiFi functionality for the Participant’s existing plan will not be affected and it will remain active during the trial.

d. For the avoidance of doubt, the terms and conditions of the Participant’s existing WiFi plan shall continue to apply during the 1Gbps trial and the Participant is still responsible to pay their usual fees and charges on their existing plan irrespective of whether or not the Participant is connected to their existing plan during the trial.

e. Upon expiration or termination of the trial, the Participant’s 1Gbps plan will be terminated and the Participant will resume using their existing WiFi plan.

3. Study of Overall Data Consumption

a. The Participant consents to Progresif sharing with UNN reports on the Participant’s overall data consumption before (2 months), after (2 months) and during trial period for the purposes of UNN’s study of overall data consumption related to the trial.

4. Trial Questionnaire and Survey

a. The Participant agrees to actively participate in and contribute to any feedback submissions, post trial questionnaire, surveys and/or any focus group workshop organized by UNN for purpose of providing feedback on the trial experience.

b. The Participant agrees to provide feedback to directly UNN through a feedback application. UNN shall provide a link directly to the Participant’s email to access the feedback application. The Participant shall inform Progresif in the event there are any changes to the Participant’s email address.

c. Participant must submit the feedback to UNN through the feedback application provided regarding the following information no less than once a week during the trial period:
i. Connection type (LAN or Wi-Fi)
ii. Bandwidth results via Ookla Speed Test
iii. Number of devices connected
iv. Issues experienced
v. Rate of the Participant’s connection experience during the trial period.
vi. Any other comments

d. Where applicable, UNN may install a physical probe at the Participant’s site to automate collection of information relating to data packets, connectivity and transmission control protocol throughput and scoring.

e. In such event, Progresif shall provide notice to the Participant of such proposed installation and the Participant shall permit UNN to access their site for the purposes of installing the physical probe on their site and for the purposes of disengaging and collecting the probe at the expiration or termination of the trial period.

f. Progresif shall be entitled to charge the Participant for the cost of the probe in the event that any damage has been caused to the Probe by the Participants or its third parties which may be due to misuse or or mishandling of the probe such as:
i. Accidents to the probe caused by the Participant (e.g., water spillage); or
ii. Tampering of the prove (e.g., changes to hardware or software which cannot be reset or fixed).

5. Terms of Use

a. The Participant agrees not to use the fiber broadband service provisioned by UNN for illegal or unlawful purpose. Where UNN has identified that the Participant is using the fiber broadband service unlawfully, Progresif reserves the right to disqualify and remove the Participant from the trial. Unlawful activities include but are not limited to:

i. sending, receiving, publishing, posting, distributing, disseminating, encouraging the receipt of, uploading, downloading or using any material which is offensive, abusive, defamatory, indecent, obscene, unlawful, harassing or menacing or a breach of the copyright, trademark, intellectual property, confidence, privacy or any other rights of any person
ii. sending or uploading unsolicited emails, advertising or promotional materials, offering to sell any goods or services, or conducting or forwarding surveys, contests or chain letters
iii. knowingly or negligently transmitting or uploading any electronic material (including, without limit, files that contain viruses, corrupted files, or any other similar software or programs) which is known or likely to cause, interrupt, damage, destroy or limit the functionality of any computer software, hardware or telecommunications equipment owned by UNN or any other internet user or person
iv. allowing activities that invade another’s privacy, cause annoyance, inconvenience or needless anxiety to any person
v. allowing activities that are in breach of any other third party’s rights, including downloading, installation or distribution of pirated software or other inappropriately licensed software, deletion of any author attributions, legal notices or propriety designations or labels in any file that is uploaded, falsification of the origin or source of any software or other material
vi. allowing anything that may disrupt or interfere with UNN’s network or services or cause a host or the network to crash
vii. launching “denial of service” attacks, “mail-bombing” attacks, “spamming” or “flooding” attacks against a host or network
viii. making excessive use of, or placing unusual burdens on, the network, for example by sending or receiving large volumes of email or excessively large mail attachments
ix. circumventing the user authentication or security process of a host or network
x. creating, transmitting, storing or publishing any virus, Trojan, corrupting programme or corrupted data.

6. Fair Usage Policy

A fair usage policy will be applied where the Participant’s bandwidth will be capped to 100Mbps when the Participant exceeds the quota of 10TB per month.

7. Non-Compliance to Trial Terms

a. Progresif shall notify the Participant of any non-compliance to these Terms & Conditions and the Participant shall remedy any non-compliance within five (5) days of the notice.

b. If the Participant fails to remedy any non-compliance within five (5) days, Progresif reserves the right to disqualify and remove the Participant from the trial.

c. Upon disqualification from the trial, the Participant’s 1Gbps plan will be terminated.
